Terms of Service

SendMyPitch is a two-sided creator-brand collaboration platform that connects Indonesian nano and micro content creators (1,000 to 100,000 followers) with brands and businesses (UMKM) seeking influencer marketing partnerships.

SendMyPitch provides tools for creators to generate AI-powered pitches, manage their media kit, and track collaboration outcomes. Brands may use the platform to receive pitches, post open briefs, and discover creators.

You may use SendMyPitch if you meet all of the following conditions:

• You are at least 18 years of age.
• You are registering as either a Creator or a Brand and agree to provide accurate information during sign-up.
• You are not prohibited from using the platform under applicable law.

To access most features, you must create an account. You agree to provide true, accurate, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

During beta, account verification is conducted via WhatsApp OTP. You must use a valid mobile number to complete verification.

SendMyPitch reserves the right to suspend or terminate accounts that contain false information or that violate these Terms.

4.1 Pitches

Creators may use the AI-powered pitch generator to create and send collaboration proposals to brands. Each pitch is sent through the in-app messaging system to the brand's account on SendMyPitch.

Pitches are automatically saved as drafts for up to 30 days. Drafts not submitted within this period will be deleted. Creators will receive a 7-day expiry warning before deletion.

4.2 Pitch Limits

Pitch generation is subject to the following monthly limits by subscription tier:

Beta users receive full Pro-tier access at no charge for the duration of the beta period.

4.3 Creator Responsibilities

By using the platform, Creators agree to:

• Provide accurate information in their profile and media kit.
• Only pitch for collaborations they are genuinely interested in and capable of fulfilling.
• Not misrepresent their follower count, engagement rate, or audience demographics.
• Not use AI-generated pitches to send spam or unsolicited bulk messages to brands.

5.1 Receiving and Managing Pitches

Brands may receive pitches from creators through the platform inbox. Brands may mark pitches as Active, pass on pitches, or allow them to expire. Passed pitches are marked accordingly and are visible to the creator.

5.2 Open Briefs

Brands on eligible tiers may post open collaboration briefs that creators can pitch against. Briefs must accurately represent the campaign requirements, timeline, and compensation structure.

5.3 Brand Responsibilities

Brands agree to:

• Respond to creator pitches in a timely and respectful manner.
• Not use the platform to collect creator data for purposes outside of genuine collaboration.
• Ensure that all posted briefs comply with Indonesian advertising regulations and applicable law.
• Honor agreed collaboration terms made through the platform.

The platform supports seven collaboration types. Both creators and brands should select the type that accurately describes the intended arrangement:

• Sponsored Post
• Product Gifting
• Recipe Collaboration
• Brand Ambassador
• Affiliate
• Event Coverage
• UGC Content

SendMyPitch uses the Anthropic Claude API to generate pitch content on behalf of creators. The AI generates personalised draft text based on information provided by the creator. The creator is solely responsible for reviewing, editing, and approving any AI-generated content before it is sent to a brand.

SendMyPitch does not warrant that AI-generated pitches will result in successful collaborations or brand responses. The platform is a tool, not a guarantee of outcome.

SendMyPitch offers free and paid subscription tiers for both creators and brands. Paid plans are billed monthly. Prices are denominated in Indonesian Rupiah (IDR) and collected via Xendit, our authorised payment partner.

Subscription fees are non-refundable except where required by applicable Indonesian consumer protection law. Downgrading your plan takes effect at the next billing cycle. You will retain access to higher-tier features until the end of the current billing period.

SendMyPitch does not process payments between creators and brands. All financial arrangements for completed collaborations are made directly between the parties.

9.1 Platform Content

All content, design, code, trademarks, and materials that form the SendMyPitch platform are owned by SendMyPitch. You may not copy, reproduce, modify, or distribute any part of the platform without prior written consent.

9.2 User Content

You retain ownership of content you upload to SendMyPitch, including your profile, media kit, and pitch text. By submitting content to the platform, you grant SendMyPitch a non-exclusive, royalty-free licence to display and transmit your content as necessary to operate the platform.

You warrant that you own or have the right to use all content you upload, and that it does not infringe any third-party intellectual property rights.

You agree not to:

• Use the platform for any unlawful purpose or in violation of applicable law.
• Impersonate any person or entity, or misrepresent your affiliation.
• Scrape, crawl, or extract data from the platform using automated tools.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure.
• Upload content that is defamatory, fraudulent, obscene, or that infringes third-party rights.
• Engage in any activity that disrupts or interferes with the normal operation of the platform.
• Use another user's account or share your credentials with third parties.

Your use of SendMyPitch is also governed by our Privacy Policy. By using the platform, you consent to the collection and use of your information as described in that policy.

We may send transactional and platform notifications via email and WhatsApp. You may manage notification preferences within your account settings.

SendMyPitch is provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific outcomes from using the pitch generation tool or any other platform feature.

SendMyPitch is not a party to any collaboration agreement between a creator and a brand. We are not responsible for the performance, quality, or legality of any collaboration arranged through the platform.

To the maximum extent permitted by law, SendMyPitch and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the platform shall not exceed the total subscription fees you paid to SendMyPitch in the three months preceding the claim.

You may delete your account at any time via your account settings. Upon deletion, your data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your access to SendMyPitch at any time if we believe you have violated these Terms, with or without prior notice. Upon termination, your right to use the platform ceases immediately.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document and notify active users via email or in-app notification. Your continued use of SendMyPitch after the effective date of any changes constitutes your acceptance of the updated Terms.

Any dispute arising from or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.

For users based in Indonesia, we will comply with applicable Indonesian consumer protection and e-commerce regulations, including Government Regulation No. 71 of 2019 on Electronic Systems and Transactions.
